§ 92.35 CONDITIONS.
   The following conditions shall constitute a public nuisance for the purpose of this subchapter:
   (A)   Litter;
   (B)   Fallen trees, stumps or dead trees;
   (C)   Boxes, appliances, furniture, household items and tires;
   (D)   Construction demolition remains;
   (E)   Accumulated garbage and trash;
   (F)   Open excavations, uncovered or improperly covered holes, whether lined or unlined, and dirt piles on any open or unfenced real estate property within the town;
   (G)   Vehicle parts, lawn equipment parts, disassembled vehicles and lawn equipment, vehicles and lawn equipment without engines, plumbing and piping materials and parts, scrap metal, unseaworthy or dilapidated watercraft, dilapidated, deteriorated or inoperable vehicles and lawn equipment, jet skis, snowmobiles, motorcycles, bicycles, trailers or mopeds, provided, however, that this category shall not be deemed to apply to duly licensed and properly zoned junk yards, scrap recycling or vehicle impounding yards when said yards are operating in compliance with state and local laws;
   (H)   Any portion of real property or any personal property which emits an offensive or dangerous odor;
   (I)   Any trash, garbage, rubbish, wastewater, filth, offal, animal waste, human excrement, which is deposited, allowed or caused to be accumulated upon any public or private property;
   (J)   Any dead animal or animal parts;
   (K)   Any matter which attracts or may attract rodents, insects, domestic or wild animals in such a manner as to create a health hazard or unsanitary or dangerous condition;
   (L)   The storage of any explosive, combustible or other material which creases a safety or health hazard;
   (M)   Any furniture, not originally designed or manufactured solely for outdoor use which is placed outdoors, or any furniture, which was originally designed or manufactured for outdoor use, which is now dilapidated or deteriorated;
   (N)   Dilapidated buildings and structures where owner not required to obtain building permit, including, but not limited to portable/temporary greenhouses, animal houses/pens and tree houses;
   (O)   Deteriorated and unused above and below ground swimming pools; and
   (P)   Any condition including but not limited to smoke, dust, noxious odors that emits from a premises which creates inconvenience, annoyance and/or discomfort that interferes with the comfortable employment of the life and property of the surrounding inhabitants.
