APPENDIX A: PARK GROUNDS RENTAL AGREEMENT
   THIS AGREEMENT, dated                                        , is by and between the Town of Albany, Indiana, hereinafter referred to as “Owner,” and                         of                            , Indiana, hereinafter referred to as “Renter”, for the town’s park grounds, hereinafter referred to as “Premises”, under the following terms and conditions:
   1.   The renter agrees to pay owner the sum of $                           for rental of Big/Depot/Water Street/1st Street park grounds. (Please circle which specific park ground this agreement applies to.) Said amount shall be paid as follows: A damage deposit in the sum of $                  is due and owing upon the signing of this Rental Agreement. The remainder of the amount due and owing to the owner shall be paid on the                        day of                             , 200    . Payment for all obligations shall be made prior to the date of the event. Renter shall rent the park grounds on the                                   day of                              , 20                       from

   2.   Owner reserves the right to demand payments in the form of cash or cashier’s check for the payment of any deposits or rental charges.
   3.   The damage deposit is payable prior to the event in the form of a cashier’s check or cash. The damage deposit will be returned after inspection of the facilities or contents and it has been determined by owner that no damage has resulted from the event of the renter.
   4.   Renter shall obtain liability and property damage insurance covering the proposed event. A certificate of insurance shall be delivered by the renter to owner showing that renter has obtained insurance covering the proposed event. The certificate of insurance shall list owner as a certificate holder and shall state that the policy cannot be cancelled without one week prior notification to owner by the insurer. The certificate of insurance shall be delivered by renter to owner one week prior to the date of the event.
   5.   Renter shall not leave excessive refuse on the grounds. A charge will be assessed for excessive refuse that requires additional cost for the disposition to owner.
   6.   Renter assumes complete responsibility for the actions of themselves and of any other person(s) involved in the activities or event.
   7.   Renter assumes all responsibility for loss or damage caused by anyone that the renter assigns space to or sublets space for display, and the like.
   8.   Renter shall provide appropriate security and police services, as required or necessary to properly control the activity or event.
   9.   The parties agree that this agreement does not constitute an agency relationship between the parties.
   10.   The renter shall save, defend, hold harmless and indemnify the owner from all claims (both threatened and asserted) for damages to persons or to property arising from the renter’s occupancy of the premises, including, but not limited to, all judgments, settlements or awards which might be entered for such claims, and also including, but not limited to, all attorneys fees the owner incurs as the result of the threat or the assertion of any claim.
   11.   This Rental Agreement, and the rights and obligations of the parties hereto, shall be interpreted and construed in accordance with the laws of Indiana.
