(A) The following automobiles and/or vehicles shall not be permitted to park or partially park upon the public streets, alleys and highways of the town for a period of time exceeding 24 hours: semi trucks, box trucks, semi truck-trailers, farm tractors, road tractors, semi trailers, oversize vehicles, school buses, church buses, passenger buses, farm wagons, motor boats, water craft, recreational vehicles, motorhomes, fifth wheels, campers, utility type trailers and pop up camper trailers.
(B) In places and at hours when stopping for loading or unloading of merchandise or materials is permitted, vehicles used for the transportation of merchandise or materials may back into a curb or park on town roadways to take or discharge loads.
(C) Individuals may obtain permission from the Town Police Department and/or the Town Council to be able to park the vehicles or partially park the vehicles upon the public streets, alleys and highways of the town for a period of time exceeding 24 hours.
(D) The owner and/or operator of the vehicles prohibited from parking or partially parking upon the public streets, alleys and highways of the town, shall not remove the vehicle from the parking place and immediately return the same to its original location and/or within a short distance of its original location. The vehicle shall not be in the same general location as it was prior to moving the same in order to be in compliance with this section.
(E) Any person violating any provision of this section commits a Class C infraction and shall be fined not less than $50 and not more than $100 for their first offense, and shall be fined not less than $100 and not more than $200 for each subsequent violation of the section that occurs within 12 months of the prior violation. Each 24 hour period of time in which the vehicle is parked in violation of this section shall constitute a separate and subsequent offense.
(F) In addition to the fine provided in division (E) for the violation of this section, if any vehicle is found parked in such a manner as to constitute a violation of this section and if it is further determined that such vehicle as parked constitutes a safety hazard, interferes with the normal flow of traffic, or blocks a street, alley or highway to the town, then and in that event, the Town Police Department shall have the right to move or remove the vehicle from its location by any reasonable means, including but not limited to towing the vehicle to a storage facility or location. Any cost and expenses incurred as a result of the moving or removal of a vehicle pursuant to this section, including any storage costs, shall be charged to the owner of the vehicle. If the removal of the vehicle results in storage of the vehicle, the vehicle shall not be removed and released from storage until payment in full is received by the town for the cost and expenses provided for and by this section.
