In case the owner or occupant of any lands abutting on a public street on which any cement sidewalk, gutter, or curb is laid shall fail within 24 hours after notice to perform and abide by all things required in this subchapter, the Village Street Commissioner may thereupon proceed to carry out the provisions of this subchapter and charge this expense thereof to such owner and occupant, or either of them, and if unpaid the amount thereof, together with a penalty of 25% in addition shall be assessed against said property and the owner and occupant in the next levy and assessment of the general village taxes of the village.
