For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ADULT BOOKSTORE. An establishment having as a substantial or significant portion of its stock and trade, books, magazines, video tapes, films, recordings, and other periodicals which are distinguished or characterized by their emphasis on matter depicting, describing, or relating to “specified sexual activities” or “specific anatomical areas” or any other “sexually explicit matter” as hereinafter defined, or an establishment with a segment or section devoted to the sale or display of such material.
ADULT MINI-MOTION PICTURE THEATER. An enclosed building with the capacity of less than 50 persons used for presenting material distinguished or characterized by an emphasis on matters depicting, describing, or relating to “specified sexual activities” or “specified anatomical areas” or any other “sexually explicit matter”, as hereinafter defined, for observation by patrons therein.
ADULT MOTION PICTURE THEATER. An enclosed building used for presenting material distinguished or characterized by an emphasis on matter depicting, describing, or relating to “specified sexual activities” or “specified anatomical areas” or any other “sexually explicit matter”, as hereinafter defined, for observation by patrons therein.
ADULT NOVELTY BUSINESS. An establishment having as its principal activity the sale of devices for the stimulation of the human genitals or devices designed for sexual stimulation.
ADULT PERSONAL SERVICE BUSINESS. An establishment having as its principal activity a person of one sex, while nude or partially nude, providing personal services for any person on an individual basis in a closed room. It includes, but is not limited to, the following activities and services: massage parlors; exotic rubs; modeling studios; body painting studios; wrestling studios; and/or individual theatrical performance. It does not include activities performed by persons pursuant to, and in accordance with, licenses issued to such persons by the state.
BATHING ESTABLISHMENTS. Any place of business which, in exchange for a fee, provides as its principal function, bathing facilities, sauna baths, steam rooms, or Turkish baths.
CABARET. A business establishment which features topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators, or similar entertainers.
ESCORT SERVICES. An establishment which provides for the services of escorting persons for a payment of a fee.
NUDE AND/OR TOPLESS SERVICES. An establishment which features or offers, as a portion of its business, the services of models, masseurs, masseuses, employees, and the like who are nude, semi-nude, or topless when performing their services.
SEXUALLY EXPLICIT MATTER. All matter defined as being sexually explicit under the provisions of Public Act 33 of 1978, being M.C.L.A. §§ 722.671 et seq., as amended, which definitions are hereby adopted and included herein by reference.
SPECIFIED ANATOMICAL AREAS. Less than completely and opaquely covered human genitals, pubic region, buttocks, and female breast below a point immediately above the top of the areola and human male genitals in a discernible turgid state, even if completely and opaquely covered.
SPECIFIED SEXUAL ACTIVITIES.
(1) Human genitals in a state of sexual stimulation or arousal;
(2) Acts of human masturbation, sexual intercourse, or sodomy; and/or
(3) Fondling or other erotic touching of human genitals, pubic region, buttock, or female breasts.
