(A) For purposes of this chapter BODY OF WATER means swimming pool, hot tub or pond within the town limits for residential use.
(B) Any property owner with a property containing a body of water, as defined in this section, shall ensure that said body of water is surrounded by a fence of at least four feet in height. Alternatively, if the body of water is less than 20 feet wide at its widest point, this section may be satisfied if the property owner causes a cover to be placed over the body of water when it is not in use.
