(A) Whenever the Town Council President apprehends that there is danger of the existence or spread of hydrophobia (rabies) or other diseases which are dangerous to and may be contracted by humans or domestic animals, he or she may issue a proclamation:
(1) Requiring any person owning or harboring a domestic animal which is susceptible to the disease to:
(a) Confine or muzzle the animal for a period of time as stated in the proclamation to prevent or limit its contact with humans or other animals; and/or
(b) To cause the animal to be vaccinated against the disease, if a vaccine is available, and the animal has not been previously vaccinated within a period of time as fixed in the proclamation, but before establishing any vaccination requirements the President shall seek the advice of the State Veterinarian or a licensed local veterinarian and shall be guided by such advice; and/or
(2) Require the strict quarantine, in accordance with the same procedures as set forth in § 95.32 of any domestic animal known or believed to have the disease; and/or
(3) Order the appropriate authorities of the town to conduct a program of control or eradication of any wild animal populations known or reasonably believed to be carriers of the disease, unless the action would be prohibited under the laws of the state or the United States.
(B) Any person who owns or harbors a domestic animal which is governed by such proclamation, and who fails to comply therewith, shall be subject to penalties as provided by § 10.99, and his or her animal shall be subject to impoundment. All costs of complying with the proclamation shall be borne by the person owning or harboring the animal unless, at its discretion, the Town Council may appropriate public funds to pay all or part of the costs.
