§ 92.01 OPEN BURNING PROHIBITED.
   (A)   It shall be unlawful for any person to engage in the open burning of any yard waste or rubbish within the town limits with the following exceptions:
      (1)   Residents may burn charcoal/wood in outdoor fireplaces and grills provided that the items shall be placed in such a location as to be reasonably removed from any residence so as to avoid any smoke or fumes therefrom becoming a nuisance for any adjacent neighbors.
      (2)   In the event that there are such unusual circumstances as to make the burning of a substantial amount of combustible material necessary, the person wishing to do so must apply to the Clerk-Treasurer for an application. Any such applications shall be considered and voted on by the Town Council. If the application is approved by them, the burning shall be done under the supervision of the Fire Department.
   (B)   Any person found violating this section shall receive a warning for first such offense. A person found guilty of a second or subsequent offense shall be fined in an amount determined by § 92.99.
