SCHEDULE III. PREFERENTIALITY OF STATE HIGHWAYS; ERECTION AND MAINTENANCE OF CONTROL SIGNS OR SIGNALS; ENFORCEMENT.
   The Indiana Department of Highways shall have exclusive power and responsibility, in accordance with statute, to determine the preferentiality of public ways within the town which are part of the state highway system or under jurisdiction of the Department, to specify the character of intersection controls at the intersection of respective streets and other public ways under town jurisdiction with such public ways under state jurisdiction and to erect and maintain all signs, signals or marking as required by law for the enforcement of the controls so determined by the Department of Highways. The Town Police Department shall enforce all such controls established by the Department of Highways, when signs or signals have been erected as required by law, but the violations shall be cited as state violations under I.C. 9-21-4-18, subject to the penalties under I.C. 9-21-4-19 and the provisions of Schedules I and II of this chapter.
