§ 33.04 STATUTE OF LIMITATIONS APPLICABLE TO CODE ENFORCEMENT.
   As provided by I.C. 34-28-5-1, no proceeding to enforce a provision of this code or to impose a penalty for the violation of the provision shall be initiated by the municipal corporation if more than two years have elapsed since the alleged act of violation or condition of noncompliance has occurred. However, in the case of any act of violation or condition of noncompliance which was not a discrete act or condition, but extended or existed over a period of time, the limitation under this section applies and is measured from the most recent date of occurrence and not from the date that the act or condition first began.
