§ 33.10 EMPLOYEE DISCIPLINARY ACTIONS; INFRACTIONS; PROGRESSIVE WARNING AND PENALTIES.
   (A)   Major infractions; immediate termination.
      (1)   Major infractions include, but are not limited to, the following:
         (a)   Being under the influence of alcohol or unlawful drugs on the job;
         (b)   Gross insubordination;
         (c)   Use of unlawful drugs;
         (d)   Fighting on the job;
         (e)   Stealing or destruction of municipal property; and
         (f)   Falsification of the employee’s application.
      (2)   Major infractions may result in immediate termination.

   (B)   Minor infractions. Minor infractions are those actions of an employee which, if inexcusably continued, will result in the progressive disciplinary proceedings as described in division (C) below, and include, but are not limited to, the following:
      (1)   Unexcused tardiness or absence of two or more occurrences in a one-month period;
      (2)   Insubordination;
      (3)   Poor appearance of the employee;
      (4)   Failure to follow instructions;
      (5)   Absence of sick leave; and
      (6)   Other actions as defined by the Town Council.

   (C)   Progressive warnings and penalties.
      (1)   The procedure for minor infractions is a system of progressive discipline, which includes the following:
         (a)   Verbal warning;
         (b)   Written warning;
         (c)   One-day suspension without pay;
         (d)   Three-day suspension without pay; and
         (e)   Termination.
      (2)   A record of every verbal and written warning shall be kept on file.
