Any non-conforming uses existing in FP, FW or FF Districts are subject to the following regulations and restrictions.
(A) Enlargement of non-conforming uses in FW Districts. No non-conforming use in a Floodway (FW) District shall be expanded or enlarged without a permit for construction in a floodway from Natural Resources.
(B) Enlargement of non-conforming uses in FF Districts. A non-conforming use in a Floodway (FF) District may be altered, enlarged or extended, on a one-time only basis; provided, such alterations, enlargements or extensions do not increase the value of the building or structure, excluding the value of land, by more than 40% of its pre-improvement market value, unless such building or structure is permanently changed to a conforming use.
(C) Enlargement of non-conforming uses in FP Districts. A non-conforming use in a Floodplain (FP) District may be altered, enlarged or extended on a one-time only basis; provided, the procedures set forth in this chapter are followed; and, further provided, such alterations, enlargements or extensions do not increase the value of the building or structure, excluding the value of the land, by more than 40% of its pre-improvement market value, unless such building or structure is permanently changed to a conforming use.
(D) Restoration of damaged non-conforming uses. Any non-conforming use in the FP, FW and FF Districts which is damaged by flood, fire, explosion, act of God or the public enemy may be restored to its original dimensions and conditions; provided, the damage dues not reduce the value of the buildings, excluding the value of the land, by more than 40% of its pre-damaged value.
