§ 151.04 APPEALS FROM BUILDING REGULATIONS AND ADMINISTRATIVE DECISIONS.
   The building authority shall serve as an appeal board with respect to all questions or disputes regarding the interpretation or application of the building regulations, the granting of building permits or orders of the Building Inspector. The building authority may grant variances from strict applicability of the building regulations; however, a variance from the regulations described in § 151.01(A)(1)(a) of this chapter, or a variance from any regulation described in § 151.01(A)(1)(b) or (A)(1)(c) of this chapter to the extent that such variance would permit some lesser or different standard than applicable under § 151.01(A)(1)(a) of this chapter may only be granted with the approval of the Fire Prevention and Building Safety Commission. In all appeals before the building authority, the burden of proof shall lie with the appellant. Further appeal may be taken to the Fire Prevention and Building Safety Commission in accordance with state law, as and if applicable to the case.
