§ 34.117 HOLIDAYS.
   (A)   The Town Council will establish a holiday schedule each year and post it prior to the beginning of the upcoming year. The holiday schedule may be amended by the Town Council, with written notice, distributed to all departments within the town government.
   (B)   Regular full-time and introductory employees are eligible for holiday pay. Part-time employees who are scheduled to work on a holiday are also eligible for holiday pay. Holiday pay will be based on the employee’s base pay rate, as of the date of the holiday times the number of hours the employee would otherwise have worked on that day. Employees may not substitute another day off instead of the designated day off.
   (C)   If the holiday falls on Sunday, it will be observed on the following Monday; if it falls on Saturday, it will be observed on the preceding Friday.
   (D)   Employees must work their last scheduled workdays immediately preceding the holiday and their first scheduled workdays immediately following the holiday to be eligible for holiday pay. This provision will not apply if the employee is scheduled to be on vacation.
   (E)   If a non-exempt employee works on a holiday, he or she shall receive his or her holiday pay and be compensated at time and one-half for all hours worked on a holiday.
   (F)   If a holiday occurs while an employee is on vacation, the vacation day will not be charged against his or her vacation leave. Employees must be in a paid status the day before and the day after a holiday in order to be paid for the holiday.
   (G)   An employee scheduled to return from a non-paid leave on the day after a holiday will not be paid for the holiday. Employees who are in an unpaid status of FMLA leave are not eligible for holiday pay.
