(A) State law (HEA #1149, being I.C. 7.1-5-12-4) prohibits smoking in any of the town’s places of employment and within eight feet of any public entrance to the town’s places of employment.
(B) Employees have a responsibility to report violations by a member of the public or other employees to the Clerk-Treasurer or Town Council. An employee may do so without fear of reprisal or retaliation. Employees who violate this policy are subject to disciplinary action, up to and including termination. In addition, any person who smokes in a non-smoking area commits a Class B infraction or a Class A infraction if he or she has at least three prior violations.
(C) This policy applies to all department heads, elected officials, employees, citizens and visitors.
(D) Violations of this policy by others in the presence of employees shall be handled in accordance with the policies and procedures adopted by the Town Council for all premises under the control of the town.
