17.22.100 Additional Review and Requirements.
   The properties in the Airport Park contain a number of public and private facilities, which are integral to the airport and the uses in this district. These facilities are operated, managed and maintained by the Adelanto Airport Property Owner's Association. In order to assure the continued safe and adequate operation and maintenance of the airport and these facilities, the following additional special provisions and requirements shall apply in the Airport Park District.
   (a)   Adelanto Airport Property Owner's Association Review. In addition to all City application review processes, all new construction and development, including any new subdivisions within the Airport Park and the Airport Park Safety Overlay District shall be subject to the review of the Adelanto Airport Property Owner's Association. Standards for Adelanto Airport Property Owner's Association Review are as follows:
      1.   Each calendar year, it shall be the responsibility of the Adelanto Airport Property Owner's Association to submit to the City a letter on official letterhead listing all members of the association and those authorized to provide comments for the group. Should this letter not be submitted on an annual basis, the City shall correspond with the Adelanto Airport Property Owner's Association with the most recent contact information provided.
      2.   It shall be the responsibility of the applicant to submit any proposed project to the Adelanto Airport Property Owner's Association (or its successor). P.O. Box 1102, Adelanto, CA 92301. The Adelanto Airport Property Owner's Association shall review, respond, and submit their written recommendations to the City of Adelanto, Planning Division regarding any submittals within thirty (30) calendar days.
      3.   Should an application for development be submitted without consultation of the Adelanto Airport Property Owner's Association, the City shall provide notification to the Adelanto Airport Property Owner's Association for comments. The requirement for consultation with the Adelanto Airport Property Owner's Association shall be defined as follows:
         a)   Comments on official letterhead from the Adelanto Airport Property Owner's Association with authorized signature(s); or
         b)   A document responding to the City's request for comments with "No Comments"; or
         c)   Verification that project information was sent to the Adelanto Airport Property Owner's Association via certified mail. Should this method be used, the City may not act on a project until 30 days after verified receipt of the project materials.
      The City shall consider the recommendations of the Adelanto Airport Property Owner's Association prior to granting any approvals for new construction, subdivision, development, or permits. Any appeals shall be directed to Planning Commission and subsequently to the City Council and decided by majority.
   (b)   Avigation and Overflight Easements. A noise and avigation easement on all subdivision parcels and roadways shall be granted and conveyed to the Southern California Logistics Airport as required in the City adopted Land Use Plan.
   (c)   Access, Utility, Runway, and Taxiway Easements/Agreements. In order to ensure adequate vehicular access, as well as use and access of the airport, prior to any development, subdivision, or issuance of building permits for any new construction the following shall be addressed:
      1.   Vehicular Access and Utilities. Provide minimum roadways consistent with the street classification system as described in the General Plan for vehicular access and for proposed and future utilities.
      2.   Runway Object Free Area/Runway Safety Area. The Adelanto Airport Owner's Association (AAPOA) shall provide for a Runway Object Free Area (ROFA) as defined in the State FAA permits.
         The Runway Object Free Area (ROFA) also incorporates the Runway Safety Area (RSA) required to enhance the safety of airplanes that overshoot, overrun, or veer off the runway. The Runway Safety Area (RSA) is centered on the runway centerline and is within the Runway Object Free Area (ROFA), see Figure 1 Runway Object Free Area/Runway Safety. All distances will be measured from the centerline of each runway as defined by the State FAA permits.
      3.   Taxiways. Taxiway access shall be provided for all properties to the runways. Taxiway easements shall have a minimum width of fifty (50) feet.
