(a) An application shall be filed pursuant to the provisions of Chapter 17.100 of this Zoning Code. Upon acceptance of a Temporary Use Permit application as complete, the Planning Director or his/her designee shall review the application for conformance with the provisions of this Zoning Code. No public hearing shall be required. Based on this review, the Planning Director shall act to approve, conditionally approve, or deny the application.
(b) Within fifteen (15) days of receiving a completed application, the Planning Director shall prepare a written report stating his/her decisions and findings. The report shall recite, among other things, the facts and reasons for granting or denying the application. The report shall be mailed to the applicant via certified mail or by similar means guaranteeing proof of delivery.
(c) The Planning Director may, at his/her discretion, refer the Planning Use Permit to the Planning Commission for review and approval. In this case, the Planning Commission shall have the authority to approve or deny the application. Noticing and appeal procedures in this case shall be the same as for a Staff-approved application.
