§ 32.44 LIMITATION OF LIABILITY DURING STATE OF EMERGENCY OR EMERGENCY MANAGEMENT TESTS.
   Pursuant to I.C. 10-14-3-15, any function or activity relating to emergency management is a governmental function; therefore, except in cases of willful misconduct, gross negligence, or bad faith, any individual complying with or reasonably attempting to comply with any order or rule adopted under this chapter, or under any ordinance relating to or arising from any emergency or an emergency management test performed under the direction of the Civil Defense Director (to include, but not limited to, mock or practice attacks and exercises), shall not be liable for the death or injury caused to any person or property as a result of said activity.
