The County Highway Department shall develop a petition for variance form and shall maintain said forms at the Highway Department office and shall make said forms available to any landowner upon request. Said petition shall be in recordable form, shall be signed by the landowner of record, and if the variance is granted, shall evidence the date said variance was granted and shall evidence the landowners legal obligation to maintain or replace any culverts or drainage tile used in lieu of side ditches, which petition shall be recorded at the landowner’s expense so that such obligation shall be binding upon the landowner and his or her successors and assigns.
