§ 152.34 COURT PROCEEDINGS AND DAMAGES.
   (A)   Court proceedings. In the event the County Highway Department and the person(s) are unable to informally settle, as described in § 152.32, then the Board of Commissioners may initiate legal proceedings against the person(s) to obtain a judgment as to the costs and expenses associated with the repairs made to the damage to streets and highways under the county’s jurisdiction caused by the person(s).
   (B)   Damages. In the event that the Board of Commissioners is awarded a judgment for the costs and expenses of the repairs by a court of competent jurisdiction against the person(s), then the Board of Commissioners shall be entitled to costs of the proceedings, pre-judgment interest at the statutory rate, and reasonable attorney fees.
