§ 130.01 CURFEW IN COUNTY-OWNED PARKS.
   (A)   Definitions. For the purpose of this section, the following definitions apply unless the context clearly indicates or requires a different meaning.
      CITATION. A written civil citation issued by the County Sheriff’s Department or other law enforcement officer with jurisdiction within the county to any person(s) who violates this section.
      CURFEW. 10:00 p.m., local time, until 6:00 a.m., local time, in which all persons are to be prohibited from entering upon and/or remaining within any park of the county.
      PARK OF THE COUNTY. Any buildings, lawns, parking lots, or other areas located within any of the following:
         (a)   Linn Grove Park;
         (b)   Limberlost Park;
         (c)   Fields Memorial Park;
         (d)   Monroe Lions Park; and
         (e)   Former Monmouth Elementary School grounds.
      PENALTY. A monetary fine imposed by the county and memorialized in the citation against persons violating this section.
   (B)   Enforcement.
      (1)   Violation(s). It shall be a violation of this section for a person or persons to enter upon or remain within a park of the county, as defined in division (A) above, during the time of curfew, established in division (A) above. Violators of this section shall be cited for said violation by the County Sheriff or other local law enforcement official with jurisdiction to issue citations for violations of this section.
      (2)   Citations. All persons who are issued a citation for violations of this section shall either pay the Clerk of the Adams Superior Court the penalty referenced in the citation; or they shall be required to appear in the Superior Court of the county to show cause for their alleged violation(s).
      (3)   Deposit of fines into General Fund. All fines assessed and collected for a violation of this section shall be deposited into the County General Fund.
