(A) The County Plan Commission has authority to regulate intensive livestock operations within the county. The state has the authority to regulate confined feeding operations. Consequently, there are different requirements for each type of operation with varying setbacks to ensure the public health, safety, and general welfare.
(B) Each applicant shall have the option to comply with either the county’s regulations or to apply for a state license to be issued by the Department of Environmental Management. All applicants, regardless of whether they elect to apply for a confined feeding operations license from the state, shall be required to also submit an application to the Plan Commission for purposes of ensuring compliance with all local applicable ordinances.
