(A) Any permit that has been issued and granted under this chapter may be revoked if the applicant does not file an after built survey upon completion of construction of new intensive livestock operation facilities, or at any time after the Plan Commission and/or County Health Department provides 30 days written notice to the permittee of violations of this chapter and/or conditions of the permit. After the 30 days, the Plan Commission shall conduct a hearing and issue findings and determine whether the violations have been cured.
(B) If the violations have not been cured after 30 days, the Plan Commission may consider whether revocation of the permit is proper. In the event the Plan Commission revokes a permit, then the permittee shall have 30 days to remove the livestock from the permitted premises. In the event there is a violation resulting in immediate threat, then the permittee shall not be entitled to the notice described in division (A) above.
