(A) Fees.
(1) The County Landfill Superintendent, or in the event collection of any landfill gate fees is transferred to the County Solid Waste Management District, the Director of said district, shall assess a user’s fee to the operator of any vehicle who transports and delivers a load of waste to a landfill site located within the county. Said fees shall be a minimum of $7 per car, including station wagons, $15 per pickup truck, including any size van, and $20 per pickup truck for those who are private or commercial haulers who deliver waste to the county landfills. If the Superintendent, Director, or the designated landfill employee determines that a load exceeds a standard load for such vehicle, an adjustment to the fee charged at the gate shall be made and designated on the gate ticket prior to acceptance of the load.
(2) Delivery of the load upon receipt of the ticket shall be deemed acceptance of such charge by the vehicle operator.
(3) Any vehicle used by cities or towns to collect waste from its citizens, and any commercial haulers using vehicles in excess of 9,000 pounds gross weight, shall be charged $9 per cubic yard of waste delivered to the County Landfill.
(B) Allocation of landfill fees. The County Superintendent, or the Director of the County Solid Waste Management District in the event the district is responsible for collection of landfill fees, shall allocate the landfill fees as follows.
(1) Pursuant to I.C. 13-20-21-6, $0.50 per vehicle having gross weight of 9,000 pounds or less and $0.50 per ton for waste delivered in vehicles in excess of 9,000 pounds gross weight shall be set aside and paid to the state, as required by law.
(2) The Superintendent or District Director shall next pay into the County Solid Waste Management Fund on a monthly basis an amount equal to $1.50 per cubic yard of all waste delivered to the County North Landfill. Thereafter, the County Landfill Superintendent or the District Director shall multiply the remaining balance by a figure of 30%, which percentage of fees collected shall be deposited in the special account-pursuant to I.C. 36-9-30-22, known as the County Solid Waste Disposal Non-Reverting Capital Fund.
(3) All remaining amounts collected shall be transferred by the County Landfill Superintendent or the District Director to the County General Fund.
