351.21 SNOW EMERGENCIES.
   (a)   Council establishes a snow emergency in the event an emergency snow condition shall exist at such time as a uniform accumulation of four inches of snow has accumulated upon the streets of the Village as determined by the Village Administrator and the Chief of Police, or their respective designees, or as determined by the local U.S. Weather Station. A snow emergency shall also exist at such time as the Village Administrator and the Chief of Police, or their respective designees, agree that the quantity of snow of the weather conditions constitute a hazard to persons traveling on the streets or highways. Immediately upon making such determination, the Village Administrator and the Chief of Police, or their respective designees shall issue a joint statement to local news media and shall use all reasonably available means to provide notification of the existence of such condition. The Village shall, after the effective date of this section, post appropriate signs throughout the Village to give the public additional notice of the existence of the provisions of this section and the depth of the snowfall necessary to cause an emergency snow condition to exist.
   An emergency snow condition shall cease to exist upon the removal or melting of the snow accumulation from the Village streets or when the Village Administrator and Chief of Police or their respective designees concur that such emergency has ceased to exist. Notice of the cessation of the emergency shall be given through the local news media and all other reasonably available means of general communication.
   (b)   During the existence of an emergency snow condition, no person shall park a motor vehicle upon the following public streets in the Village, as follows:
   No parking shall be permitted on Gilbert Street from Lima Avenue to North Street; Johnson Street from Lima Avenue to North Street; Simon Street Lima Avenue to North Street; Lincoln Avenue from Corporation line to Corporation line; Turner Avenue from Main Street to Grand Avenue; Montford Avenue from Main Street to Liberty Street, Highland Avenue from Gilbert Street to Simon Street, Buckeye Avenue from Johnson Street to Grand Avenue and University Avenue from Main Street to Ream Street.
   (c)   Vehicles parked in violation of this section will be towed at the expense of the owner. The registered owner of a vehicle parked in violation of this section is prima-facie liable. Whoever violates this section is guilty of a minor misdemeanor and shall be subject to a fine of not more than one hundred dollars ($100.00).
   (d)   During a declared snow emergency, this section shall supersede all other parking regulations.

   (e)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
