(a) If a violator of the restrictions on stopping or parking under this chapter does not appear in response to a parking violation affixed to such vehicle within a period of forty-eight hours or fails to or refuses to deposit bail as provided within a period of forty-eight hours, the Police Chief or his agent shall forthwith have a summons entered against the owner of such vehicle to which the parking violation was affixed and such owner shall appear before the court of jurisdiction.
(b) Such summons will contain the number of such parking violation which was issued.
(c) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
