339.12 EXCESSIVE OPERATION OF STATIONARY TRUCK ENGINES.
   (a)   No person shall operate or permit the operation of a bus or truck engine for more than three minutes while the vehicle is stationary at a terminal, on a public street or highway, on a private or public parking lot or other outdoor locations except under the following conditions:
      (1)   When the outdoor temperature goes below the thirty-two degrees Fahrenheit.
      (2)   When the operation is necessary for the maintenance or repair of the engine or for the safe operation of the vehicle.
   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
