An individual obtaining confidential employee personnel record information or sewer and water customer account owner records under the provisions of this chapter may not treat or handle the information in such a manner as to outrage or cause mental suffering, shame or humiliation to a person of ordinary sensibilities. Such action may subject the individual under common law to tort action by the injured party. (See "Housh v. Peth, 165 Ohio St. 35, 133 N.E. 2d 340 (1956)" and "McCormick v. Haley, 37 Ohio App. 2nd 73, 307 N.E. 2d 34 (1973)", and 43 O Jur 2d Privacy S2 (1973)".
