107.04 SEWER AND WATER ACCOUNT RECORDS.
   Sewer and water account owner records shall be deemed confidential and privileged with controlled access with such account owner having certain vested privacy rights over his or her usage, billing and payment records.
   (a)    Each sewer and water account owner's name, account number and residence shall be a public record available upon request.
   (b)    Summaries or multiple listings of other account information shall be released upon request providing that such release be in a form that makes the account owners nonidentifiable and that the information can be readily prepared under the provisions of Section 107.06.
   (c)    Records of particular account owner's payments, dates of payments, amounts, delinquencies, shut-offs and usage shall be confidential and privileged with the account owner's financial privacy guaranteed and only released under the following conditions.
      (1)    All requests to view or obtain copies of an individual sewer or water account owner's private financial records shall be made in writing to the Village Administrator specifying the names and addresses of the account owners whose records are being requested, the specific records being requested, and the reasons for such request.
      (2)    Upon receipt of a written request as outlined, the Village Administrator shall forward a photocopy of such request to the Mayor and Fiscal Officer.
      (3)    Within three business days of the receipt of the request the Village Administrator shall notify the appropriate sewer or water account owner(s) in writing of such request, enclosing a photocopy of the request, and advising the account owner(s) of their rights.
         A.    The account owner has the right to be present at the viewing of his/her records at a time of his/her convenience.
         B.    The account owner may, in writing, waive his right to be present and grant release of his/her records.
         C.    Such notification shall advise the account owner(s) that should they not respond within ten working days it shall be deemed that consent to release has been granted.
      (4)    The Administrator shall in writing notify the appropriate persons of the time and place of a scheduled viewing.
