929.02 DEFINITIONS.
   For the purpose of this chapter, the words and phrases shall be defined as follows, unless the context clearly indicates or requires a different meaning.
   (a)   Division of Stormwater Management Utility. There shall be a division of stormwater management utility, within the Village of Ada, Ohio, which shall be responsible for developing and implementing stormwater management plans and solely managing facilities, stormwater systems and stormwater sewers. This division shall charge a storm drainage service charge based on individual contribution of runoff to the system, benefits enjoyed and service received. The division of storm water management utility shall be administered by the Village Administrator. The Village is authorized to proceed towards implementation of a stormwater management utility and formal commencement of operations including implementation and collection of the storm drainage service charge will begin on September Billing, due October 10th, 2004.
   (b)   Director. The Director of the stormwater management utility shall be the Village Administrator.
   (c)   Stormwater System. Stormwater System shall mean all man-made facilities, structures and natural water courses used for collecting and conducting stormwater to, through, and from drainage areas to the points of final outlet including, but not limited to, any and all of the following: conduits and appurtenant features, canals, creeks, channels, catch basins, ditches, streams, gulches, gullies, flumes, culverts, siphons, streets, curbs gutters, dams, floodwalls, levees and pumping stations.
   (d)   Facilities Not Qualifying. Facilities not qualifying as public facilities include, but are not limited to:
      (1)   Private parking lot storm drains;
      (2)   Roof, footing, and area drains;
      (3)   Drains not designed and constructed for use by the general public;
      (4)   Open drainage swales, retention/detention basins, or ditches on private property for which no public easement of record has been granted;
      (5)   Access drive culverts.
   (e)   Subdivision Development. The improvement of both public and private storm drainage facilities through or immediately adjacent to a new development shall remain the responsibility of the developer. Such improvement shall comply with the policies and standards outlined in the Village’s Subdivision Regulations.
