905.08 NUISANCE CONDITIONS PROHIBITED.
   (a)   The owners and or occupants or any person having the care of any building, lot or land in the Village shall keep the entire width of any sidewalk from the curb or edge of street to the lot line in front of or alongside of such property free from filth, mud, dirt, merchandise, rubbish or any nuisance, impediment or obstruction which may damage property of another or injure any person traveling along or upon such sidewalk.
   (b)   The owners and or occupants or any person having the care of any building, lot or land in the Village shall not cause filth, mud, dirt, rubbish or any nuisance including snow or ice which they have removed from such sidewalk, driveway or parking lot to be thrown into any public highway, alley, street, or public place or on to the private property of another.
   (c)   No owner and or occupant or any person having the care of any building or lot in the Village shall refuse, fail or neglect to repair and keep free from nuisance and obstruction, the sidewalk in front or alongside of such property after due notice, ordering the repair of such sidewalk, the removal of such obstruction or the abatement of such nuisance.
   (d)   If the owners and or occupants or any person having the care of any building or lot in the Village fails to comply with such notice, Council shall cause the sidewalk to be repaired. All expenses and labor costs incurred shall when approved by Council be paid out of municipal funds. Council shall make a written return to the County Auditor of its action with a statement of the charges for its services, the amount paid for labor, the fees of the officers serving such notices and a proper description of the premises. Such amounts, when allowed shall be entered upon the tax duplicate of the property owners or owners of the lot abutting such sidewalk and are a lien upon such lands from and after the date of the entry and be collected as other taxes and returned to the Municipality.
