3-1-8: CLASSIFICATION OF LICENSES; FEES:
   A.   Definition: For the purposes of this section, the term "primary business is the sale of food and beverage" means that over sixty percent (60%) of the gross revenues of the licensee is derived from the sale of food and beverage.
   B.   Classes And Fees Established: The licenses for the sale of liquor within the city are divided into the following classes and require payment of the following annual fees:
      1.   Class 2 License: Class 2 license, which shall authorize the sale of alcoholic liquor for consumption on or off the premises where sold. The annual fee for such license shall be one thousand one hundred dollars ($1,100.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
      2.   Class 2-A License: Class 2-A license, which shall authorize the sale of alcoholic liquor for consumption on or off the premises where sold. The annual fee for such license shall be one thousand four hundred dollars ($1,400.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
      3.   Class 3 License: Class 3 license, which shall authorize the sale of alcoholic liquor in its original package and not to be consumed in the premises where sold. The annual fee for such license shall be five hundred dollars ($500.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
      4.   Class 3-A License: Class 3-A license, which shall authorize the sale of alcoholic liquor in its original package and not to be consumed on the premises where sold. The annual fee for such license shall be eight hundred dollars ($800.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
      5.   Class 4 License: Class 4 license, which shall authorize the sale of beer for consumption on or off the premises where sold. The fee for such license shall be three hundred fifty dollars ($350.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
      6.   Class 4-A License: Class 4-A license, which shall authorize the sale of beer for consumption on or off the premises where sold. The fee for such license shall be six hundred dollars ($600.00). This license shall be issued only to a licensee whose primary business is the sale of food and beverage and not video gaming.
