10-9-3: ENLARGEMENT OF NONCONFORMING USE:
   A.   A nonconforming use in any district may be enlarged by adding to the building in which such use exists, or may be extended by acquiring additional adjoining land and constructing thereon a building to be used in connection with such nonconforming use.
   B.   As a condition precedent to any enlargement or extension of a nonconforming use, the proposed enlargement or extension shall be presented to the plan commission for its review and report, which shall be after a public hearing held in accordance with section 10-2A-6 of this title.
   C.   Any enlargement or extension will:
      1.   Not be detrimental to, or endanger the public health, safety, morals, comfort, or general welfare;
      2.   Not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted;
      3.   Not substantially diminish and impair property values within the neighborhood; and
      4.   Not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district.
   D.   The person who applies for an enlargement or extension of a nonconforming use shall pay a filing fee to the city clerk in the sum of fifty dollars ($50.00), which fee shall not be refundable. (2006 Code § 10-2-4-6)
