10-9-2: NONCONFORMING BUILDINGS:
   A.   Continuance Of Use; Change Of Use:
      1.   The lawful use of a building existing on the effective date hereof may be continued although such use does not conform with the provisions hereof.
      2.   If no structural alterations are made, a nonconforming use of a building may be changed to another nonconforming use of the same or of a more restricted classification.
      3.   Whenever a nonconforming use is changed to a more restricted use or to a conforming use, the use shall not thereafter be changed to a less restricted use.
   B.   Extension Of Use: The nonconforming use of a building may be hereafter extended throughout those parts thereof which were lawfully and manifestly arranged or designed for such use prior to the effective date hereof. (2006 Code § 10-2-4-1)
   C.   Discontinuance Of Use: No building or portion thereof used in whole or in part for a nonconforming use in any residential district, which remains idle or unused for a continuous period of two (2) years, whether or not the fixtures or equipment are removed, shall again be used except in conformity with the regulations of the residential district in which it is located.    D.   Restoration Of Damaged Building:
      1.   No building which has been damaged by any cause whatsoever to the extent of more than fifty percent (50%) of the fair market value of the building immediately prior to such damage shall be restored except in conformity with the regulations of this title, and all rights as a nonconforming use are terminated.
      2.   If a building is damaged by less than fifty percent (50%) of the fair market value of the building immediately prior to such damage, it may be repaired or reconstructed and used as before such damage; provided, that such repair or reconstruction be substantially completed within twelve (12) months after the date of such damage.
