1-5-3: DUTIES:
   A.   Generally: The mayor shall perform all the duties which are prescribed by law, including ordinances, and shall take care that the laws and ordinances are faithfully executed. The mayor from time to time may, and annually shall, provide the corporate authorities information concerning the affairs of the city and may recommend, for their consideration, measures the mayor believes expedient.    B.   Appointment Of Officers:
      1.   Except as otherwise provided by statute or by the personnel code of the city, the mayor shall appoint, by and with the consent of the city council, the officers of the city. Vacancies in all appointed municipal offices may be filled in the same manner.
      2.   An appointed officer of the city may resign from office. If an appointed officer resigns, the officer shall continue in office until a successor has been chosen and has qualified.
      3.   If an appointed municipal officer ceases to perform the duties or to hold the office by reason of death, permanent physical or mental disability, conviction of a disqualifying crime, or dismissal from or abandonment of office, the mayor may appoint a temporary successor to the officer.    C.   Removal Of Appointed Officer: Except as otherwise provided by statute or by the personnel code of the city, the mayor may remove any officer appointed by the mayor, on any written charge, whenever the mayor is of the opinion that the interests of the city demand removal. The mayor shall report the reasons for the removal to the corporate authorities at a meeting to be held not less than five (5) nor more than ten (10) days after the removal. If the mayor fails or refuses to report to the corporate authorities the reasons for the removal, or if the corporate authorities, by a two-thirds (2/3) vote of all members authorized by law to be elected, disapprove of the removal, the officer thereupon shall be restored to the office from which the officer was removed. The vote shall be by ayes and nays (or by yes and no), which shall be entered upon the journal of the corporate authorities. Upon restoration, the officer shall give a new bond (if applicable) and take a new oath of office. No officer shall be removed a second time for the same offense. (2006 Code § 2-1-6)
   D.   Supervision Of Officers: Except as otherwise provided by statute or by the personnel code of the city, the mayor shall supervise the conduct of officers of the city for the faithful and efficient discharge of the duties of their respective offices. (2006 Code § 2-1-5)
   E.   Examination Of Records: The mayor, at all times, may examine and inspect the books, records, and papers of any agent, employee, or officer of the city. (2006 Code § 2-1-7)
   F.   Signature Requirements:
      1.   The mayor shall sign all instruments on behalf of the city which require the signature of the chief executive officer. In all contracts in which the city is a party, unless otherwise provided, the mayor shall sign the same on behalf of the city, with the consent of the city council.
      2.   The mayor may designate in writing another person to affix the signature of the mayor to any written instrument required to be signed by the mayor. The written notice of the designation shall be sent to the corporate authorities, stating the name of the person who has been selected and what instruments the person will have authority to sign. A written signature of the mayor executed by the designated person, with the signature of the designated person underneath, shall be attached to the notice; and the notice, with the signatures attached, shall be recorded in the journal of the corporate authorities and then filed with the city clerk. When the signature of the mayor is placed on a written instrument at the direction of the mayor in the specified manner, the instrument in all respects shall be as binding on the city as if signed by the mayor in person.    G.   Call Out Militia: Subject to the authority of the governor as commander in chief of the militia, the mayor may call out the militia to aid in suppressing riots and other disorderly conduct, or to aid in carrying into effect any law or ordinance. (2006 Code § 2-1-8)
