6-1-4: ACCIDENTS:
   A.   Accident Involving Death Or Personal Injuries:
      1.   The driver of any vehicle involved in a motor vehicle accident resulting in personal injury to or death of any person shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible, and shall then forthwith return to and in every event shall remain at the scene of the accident until the requirements of subsection C of this section have been fulfilled. Every such stop shall be made without obstructing traffic more than is necessary.
      2.   In this section, "personal injury" means any injury requiring immediate professional treatment in a medical facility or doctor's office. (2006 Code § 9-2-3-1)
   B.   Accident Involving Damage To Vehicle: The driver of any vehicle involved in a motor vehicle accident resulting only in damage to a vehicle which is driven or attended by any person shall immediately stop the driver's vehicle at the scene of such motor vehicle accident or as close thereto as possible, and shall forthwith return to and in every event shall remain at the scene of such motor vehicle accident until the requirements of subsection C of this section have been fulfilled. Every such stop shall be made without obstructing traffic more than is necessary. (2006 Code § 9-2-3-2)
   C.   Duty To Give Information And Render Aid:
      1.   The driver of any vehicle involved in a motor vehicle accident resulting in injury to or death of any person or damage to any vehicle which is driven or attended by any person shall give the driver's name, address, registration number, and owner of the vehicle the driver is operating, and shall, upon request and if available, exhibit such driver's license to the person struck or the driver or occupant of or person attending any vehicle collided with, and shall render to any person injured in such accident reasonable assistance, including the carrying, or the making of arrangements for the carrying, of such person to a physician, surgeon, or hospital for medical or surgical treatment, if it is apparent that such treatment is necessary or if such carrying is requested by the injured party.
      2.   If none of the persons entitled to information pursuant to this subsection C is in condition to receive and understand such information and no police officer is present, such driver, after rendering reasonable assistance, shall forthwith report such motor vehicle accident at the police department, disclosing the information required by this subsection C.    D.   Accident Involving Unattended Vehicle Or Other Property: The driver of any vehicle which collides with or is involved in a motor vehicle accident with any vehicle which is unattended, or other property, resulting in any damage to such other vehicle or property, shall immediately stop and shall then and there either locate and notify the operator or owner of such vehicle or other property of the driver's name, address, registration number, and owner of the vehicle the driver was operating, or shall attach securely in a conspicuous place on or in the vehicle or other property struck a written notice giving the driver's name, address, registration number, and owner of the vehicle the driver was driving, and shall, without unnecessary delay, notify the nearest office of a duly authorized police authority and shall make a written report of such accident when and as required in subsection E1a of this section. Every such stop shall be made without obstructing traffic more than is necessary. (2006 Code § 9-2-3-4)
   E.   Accident Reports:
      1.   Certain Accidents Reported To State:
         a.   (1) The driver of a vehicle which is in any manner involved in an accident within this city resulting in injury to or death of any person, or in which the property of any person, including himself, in excess of five hundred dollars ($500.00) is sustained, shall, as soon as possible, but not later than ten (10) days after such accident, forward a written report of such accident to the Illinois department of transportation.
            (2)   Whenever a school bus is involved in an accident in the city caused by a collision, a sudden stop or otherwise, resulting in any property damage, personal injury, or death, and whenever an accident occurs within fifty feet (50') of a school bus in the city resulting in personal injury to or the death of any person while awaiting or preparing to board the bus or immediately after exiting the bus, the driver shall, as soon as possible, but not later than ten (10) days after the accident, forward a written report to the Illinois department of transportation. If a report is also required under subsection E1a(1) of this section, that report and the report required by this subsection E1a(2) shall be submitted on a single form. (2006 Code § 9-2-3-5)
         b.   (1) The driver of a vehicle which is in any manner involved in an accident described in subsection E1a of this section shall, if no police officer is present, give notice of the accident by the fastest available means of communication to the police department.
            (2)   Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required in subsection E1a of this section and there was another occupant in the vehicle at the time of the accident capable of doing so, that occupant must give notice as required in subsection E1a of this section.
            (3)   If neither the driver nor other occupant provides notice as required in subsection E1a of this section, the owner of the vehicle involved in the accident shall, as soon as practicable, make the report. (2006 Code § 9-2-3-6)
      2.   Reports To City: The driver or owner of a vehicle involved in a traffic accident shall file with the police department a written report of such accident. Such report shall be for the confidential use of the police department and remain subject to the provisions of Illinois state laws. (2006 Code § 9-2-3-8)
      3.   Report Form: Every accident report required to be made in writing must be made on an appropriate form approved or provided by the state of Illinois and the police department and must contain all the information required unless that information is not available. (2006 Code § 9-2-3-9)
      4.   False Reports Prohibited: It is unlawful for any person to provide information in an oral or written report required by this section with knowledge or reason to believe that such information is false. (2006 Code § 9-2-3-7)
