A. No person shall burn, or allow to be burned, any material within the city, except landscape waste upon the premises where it is produced and at the times provided herein. (2006 Code § 6-7-1)
B. Burning shall be allowed from January 1 through December 31 of each year between seven o'clock (7:00) A.M. until seven o'clock (7:00) P.M. on Tuesday, Thursday and Saturday of each week.
C. Notwithstanding the restrictions of subsection B of this section, burning shall be allowed: 1) for the purposes of family events, cookouts, use of fire pits, etc., if approved in advance by the city police department; and 2) for cleanup after a weather related emergency, which state of emergency has been declared by the mayor. D. No burning of any landscape waste whatsoever shall be allowed within the city on any Sunday or Monday.
E. Burning shall be considered to continue so long as a fire remains smoldering.
F. The allowance of burning during the times set forth in this section does not relieve any person from the provisions contained in chapter 1 of this title prohibiting nuisances. (2006 Code § 6-7-1)
