3-2-4: PROHIBITED ACTS; REVOCATION OF LICENSE:
   A.   Prohibited Acts:
      1.   a. Unless otherwise provided in subsection A1b of this section, it shall be unlawful for any peddler to conduct business at any residential unit earlier than nine o'clock (9:00) A.M. or later than five o'clock (5:00) P.M. (2006 Code § 3-4-4; amd. 2016 Code)
         b.   It shall be unlawful for ice cream truck salesmen to conduct business at any residential unit earlier than nine o'clock (9:00) A.M. or later than eight o'clock (8:00) P.M. (Ord. 2011-6, 6-20-2011; amd. 2016 Code)
      2.   It shall be unlawful for any peddler to attempt to sell or sell any merchandise, other chattel, or service other than those specified in the peddler's application for a license, or to make any material misrepresentation concerning the merchandise, other chattel, or service, or to engage in any fraudulent conduct.
      3.   It shall be unlawful for any peddler to refuse to leave the premises of any residential unit after having been requested by the owner or other occupant to leave.
      4.   In the event that the premises of any residential unit is posted against solicitation by means of a notice prominently displayed, upon which is printed "No Peddlers" or "No Solicitors", it shall be unlawful to engage in business as a peddler on such premises. For the purpose of this subsection A4, a residential unit shall be deemed to be posted against peddlers if there is exhibited on or near the main entrance to the premises, or on or near the main door to any residential unit located on the premises, a sign at least three inches by four inches (3" x 4") in size which bears either of the above legends in letters at least one-third inch (1/3") in height.       5.   Any unlawful act described as fraud, misrepresentation, or incorrect statements on the application form.
      6.   A complaint by a citizen of the City of Abingdon regarding the peddler of harassment, badgering, refusal to leave complainant's residence when requested.
      7.   Fraud, misrepresentation, or false statements made during the course of the licensed activity.
      8.   Conviction of any offense for which granting of a license could have been denied under this chapter.
      9.   The revocation within the past five (5) years of any license issued to the applicant for the purpose of conducting business as a peddler, solicitor, or transient merchant. (Ord. 2018-3, 5-21-2018)
   B.   Revocation Of License: Any unlawful act described in subsection A of this section is cause for revocation of any or all licenses issued to that person. Revocation of any license may be effected by the Mayor. (2006 Code § 3-4-4)
