3-2-3: APPLICATION FOR LICENSE; ISSUANCE; CONTENTS OF LICENSE:
   A.   An application for each license shall be made to the City Clerk on forms prescribed by the Corporate Authorities which shall specify the following information:
      1.   Applicant's full legal name.
      2.   All other names under which the applicant conducts business or to which applicant officially answers.
      3.   Names and descriptions of all the persons proposed to be used in this City during the period for which application is made.
      4.   Full address of applicant's permanent residence.
      5.   Telephone number of applicant's permanent residence.
      6.   Full legal name of any and all business operations owned, managed, operated by applicant, or for which the applicant is an employee or agent.
      7.   The telephone number that applicant can be reached while conducting business within the City, including the location where a transient merchant intends to set up business.
      8.   A statement as to whether or not the applicant has, and/or any of the persons to be used in this City during the period for which application is made have, been convicted within the last five (5) years of a felony, misdemeanor for violation of any State or Federal Statute or any local ordinance, other than traffic offenses.
      9.   A list of the three (3) most recent locations where the applicant has conducted business as a peddler or transient merchant.
      10.   Proof of any required County license.
      11.   Written permission of the property owner or the property owner's agent for any property to be used by a transient merchant.
      12.   All additional information deemed necessary by the City Council. (Ord. 2018-3, 5-21-2018)
   B.   Each applicant shall also exhibit two (2) valid means of identification to the City Clerk. (2006 Code § 3-4-3)
   C.   Within two (2) business days of the making of the application, the City Clerk shall issue the license, if all of the requirements of this chapter have been met and the City Clerk has determined that:
      1.   The applicant's ability to conduct the business for which the license is being sought in an honest and legal manner or that will not adversely affect the health, safety, and welfare of the residents of the City. Such violations shall include, but not be limited to: burglary, theft, larceny, swindling, fraud, unlawful business practices, and any form of actual or threatened physical harm against another person.
      2.   No license issued to any applicant for the purpose of conducting business as a peddler, solicitor, or transient merchant has been revoked within the past five (5) years.
      3.   The applicant has a bad business reputation. Evidence of a bad business reputation shall include, but not be limited to, the existence of more than two (2) complaints against the applicant with the Better Business Bureau, the Attorney General's Office, any other similar business or consumer rights office or agency, or the City of Abingdon, within the preceding twelve (12) months, or five (5) such complaints filed against the applicant within the preceding five (5) years.    D.   Each license issued shall state on its face the date on which it expires. (2006 Code § 3-4-3)
