§ 90.42 UNLAWFUL ACT AND PERMIT REQUIRED.
   (A)   It is unlawful for any person to construct or maintain an excavation on private property or public property which is not owned or under the control of the city, without a written permit from the city.
   (B)   All applications for a permit shall be made on forms furnished by the city, and all permits shall be issued on conditions that will protect persons and property from damage or injury.
