(A) It is unlawful for any person to operate a motorcycle, except as follows:
(1) On a roadway, if the operator has a valid standard driver’s license, with a two-wheeled vehicle endorsement as provided by law, or a valid two-wheeled vehicle instructional permit or a special motorcycle permit as issued by the Public Safety Liaison; or
(2) On private property, if the operator has permission of the owner or other person entitled to the possession of the property.
(B) It is unlawful for any person to:
(1) Operate or park a motorcycle on a public sidewalk or boulevard. A
BOULEVARD is defined as the area of the public roadway lying between the sidewalk and the portion of the right-of-way of any roadway used for motor vehicle traffic;
(2) Operate a motorcycle at any place, while under the influence of alcohol or drugs as defined in M.S. § 84.92, Subdivision 8, as it may be amended from time to time;
(3) Operate or park a motorcycle in a careless, reckless or negligent manner, or heedlessly in disregard of the rights or safety of others, or in a manner so as to endanger or likely to endanger, or cause or be likely to cause injury or damage to any person or property;
(4) Operate a motorcycle in a manner or location so as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of other persons; or
(5) Operate a motorcycle, unless there is full compliance with the provisions of M.S. Chapter 169, as it may be amended from time to time, and all rules and regulations promulgated thereunder.
(C) It is unlawful for any person to operate or be in physical control of a motorcycle without a valid two-wheeled endorsement, two-wheeled vehicle instructional permit or special motorcycle permit, except on private property with the express consent of the owner or occupant of the private property.
(D) It is unlawful for any person to perform any stunts, acrobatics, racing or games of any sort, while operating a motorcycle.
(E) Parents, guardians or any other adult in charge shall be held responsible for all damages or wrongful acts conducted by a minor operating a motorcycle. It is unlawful for the parent, guardian or adult in charge to permit a minor to operate a motorcycle, if the minor violates the provisions of this section. It shall be no defense to the parent, guardian or adult in charge that he or she did not expressly allow the violation of this section or did not have knowledge of past or present violations. It is the intent of this section to require the parents, guardians or adults in charge to take adequate precautions to ensure that any minor conforms to the provisions of this section while operating a motorcycle within the city.
