919.02 PUBLIC RIGHT-OF-WAY PERMIT AND FEE.
   (a)   Before any Person shall perform any Construction work in any Public Right-of-Way or other City Property in the City, including the sidewalk, treelawn and Public Street, such Person (the Applicant) shall file an application with the City Engineering Department, on a form provided by the City, setting forth the location, the kind, extent and schedule of the proposed work to be performed, and shall obtain a Construction Permit to perform such work. The construction of signs in any Public Right-of-Way shall also be governed by Chapter 1335 of the Codified Ordinances. Any permit granted under this chapter shall be deemed a "license" for the limited purpose of satisfying the provisions of Section 901.03 (e) of the Codified Ordinances.
   (b)   The Applicant shall pay to the City a Construction Permit fee in the amount of Twenty-five Dollars ($25.00), or such other amount determined by the City Engineering Department as on file, as may be amended from time to time, to cover the cost of processing the application and the Inspectors supervision and inspection of the Construction work. Fees shall be waived by the City Engineer when the item being placed into or near the right-of-way is a mailbox or other permissible material that will require no inspection, as determined by the City Engineer.
   
   (c)   The grant of a Construction Permit pursuant to this chapter is contingent on compliance with the requirements of this chapter and when applicable Chapter 913 of the City's Codified Ordinances.
