8-16-8: RELIEF FROM CLOSURE ORDER:
A.   The owner of real property may obtain relief from a closure order if the owner:
1.   Appears and pays all civil penalties, and all costs and expenses awarded to the city; and
2.   Establishes to the satisfaction of the court that the nuisance activity has been abated and will not likely recur; and
3.   Establishes to the satisfaction of the court that all other terms and conditions of the abatement order of the court have been satisfied.
B.   Nothing in this section shall alter the abatement provisions of Oregon Revised Statutes 105.580(4) and (5), where abatement was ordered on the basis of manufacture of a controlled substance. (Ord. 950, 2-9-2009)
