§ 12.24.040 PROCEDURE.
   The following procedure will be followed in applying for the Private Road Surfacing Program:
   A.   The Township Highway Commissioner must be contacted in order to determine the nature and extent of the roadway base, drainage, and right-of-way improvements necessary to meet his requirements for accepting the road or street in the township system. The Commissioner is the final authority for determining these requirements with the approval of the County Engineer. IN NO CASE SHALL THE MINIMUM STANDARDS OF THIS PROGRAM BE WAIVED.
   B.   Prior to March 1st of each year:
      1.   The residents adjacent to the roadway shall notify the County Engineer, in writing, that the residents are planning to upgrade the road and wish to participate in the County’s program to construct the bituminous surface. A map shall be included identifying those roadways that are planned to be upgraded.
         - or -
      2.   The township highway commissioner, shall, in writing, notify the County Engineer that the road district in cooperation with the residents is planning on accepting the roadway and upgrading it to meet the minimum requirements of this program. A map shall be included identifying those roadways that are planned to be upgraded.
   C.   Prior to May 1st of each year the County will determine, based on funding limitations, which roadways of the requests submitted, will be paved in the FOLLOWING YEAR. It is the County’s requirement that all roadway bases are to be constructed and allowed to settle over one winter season before construction of the bituminous surface. Therefore, normally when the base and drainage work are completed and approved during a calendar year, the roads and streets become eligible under the County’s program for the following calendar year.
      1.   When requests for roadway surfacing exceed the funding budgeted for the program, the following priority shall be used in determining which roadways will be surfaced:
      2.   Roads that are upgraded to meet minimum County and Township standards by the residents without the assistance of the Township.
      3.   Remaining roads will be ranked, and funded, in descending order starting with those roadways that serve the largest number of dwelling units per mile of road until funding is exhausted.
   D.   Upon approval of the request for funding by the County, the residents (or township) shall perform, or cause to be performed, the necessary roadway, drainage and right-of-way work to meet the requirements of the Township Highway Commissioner and the County Highway Department. The County Engineer and the Township Highway Commissioner must be contacted at the time the actual construction is started so that proper inspections and quality control can be monitored by the Township and the County.
   E.   When construction of the base, drainage, and right-of-way work has been completed, obtain the approval of the Township Highway Commissioner and notify the County Engineer, in writing, that the work has been completed and approved by the Township Highway Commissioner. NOTE: All roadway base, drainage, and right-of-way work must be completed by November 1st in order to remain eligible for paving during the next year.
   F.   In those instances where right-of-way dedication is required, or the acceptance by the township is necessary prior to assistance, the Township Highway Commissioner must submit the necessary acceptance certifications and right-of-way documentation to the County Engineer for approval by November 1st of the year prior to paving.
