§ 96.00 DIVISION OF PARKS, RECREATION AND CEMETERY ESTABLISHED AS A DIVISION OF THE HIGHWAY DEPARTMENT.
   (A)   Pursuant to Charter § 3.01 the Department of Parks, Recreation and Cemetery is hereby reorganized and combined with the Highway Department as a division of the Highway Department.
   (B)   The division head shall be the Chief of Parks, Recreation and Cemetery who shall be appointed by the Public Works Director.
   (C)   The Division of Parks, Recreation and Cemetery shall also include a Parks, Recreation and Cemetery Division Commission consisting of five members who shall be appointed as provided by Charter § 3.14 and the Commission shall have those duties and responsibilities as assigned by the Charter and city ordinances.
   (D)   The Parks, Recreation and Cemetery Commission on the effective date of this section shall become members of the Parks, Recreation and Cemetery Division Commission with the same terms as previously held.
   (E)   The Division of Parks, Recreation and Cemetery shall be responsible for city parks, recreational facilities and programs, including school athletic facilities, and public cemeteries and shall perform such other duties as are prescribed by federal, state and local law.
   (F)   The Division of Parks, Recreation and Cemetery shall be responsible for maintaining the silicone bronze sculpture of a bull to be erected at the eastern end of the Hands Across the Merrimack Bridge.
   (G)   The positions of Parks, Recreation and Cemetery Director/Superintendent; Parks, Recreation and Cemetery Deputy Director and Parks, Recreation and Cemetery Business Service Officer are hereby eliminated in this reorganization. These positions shall be eliminated June 30, 2010. All other employees of the Department of Parks, Recreation and Cemetery are hereby transferred by this reorganization to the Division of Parks, Recreation and Cemetery of the Highway Department.
