(a) “Use of any form of tobacco” as found in this section shall mean all uses of tobacco, including inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, pipe, or other lighted smoking device or papers for burning tobacco, or any other plant; chewing tobacco, snuff, or any other matter or substances that contain tobacco.
(b) No person shall use any form of tobacco at or on any of the following Village owned or operated areas:
(1) Any and all Village owned or operated buildings;
(2) The bleachers and bleacher areas at all baseball and softball fields at Sally Buffalo Park; all baseball and softball field at Sally Buffalo Park, and all playgrounds at Sally Buffalo Park.
(c) All Village owned or operated buildings shall cause to be conspicuously posted “tobacco-free”, “no smoking” or “smoking prohibited” signs at the entrance of each such facility. Such signs shall also be posted on the bleacher or near the vicinity of the bleachers at the baseball field at Sally Buffalo Park; the baseball fields at Sally Buffalo Park and the playground at Sally Buffalo Park.
(d) A violation of this section shall be a minor misdemeanor punishable by a fine of up to $150.00 and court costs.
