1113.05 “C-1" GENERAL COMMERCIAL DISTRICT.
   (a)   Purpose. To delineate those areas where predominantly general business uses have occurred or will likely to occur in accordance with the Harrison County Regional Planning Commission’s 1995 Comprehensive Plan, as adopted by the Village of Cadiz Planning Commission and the Council of the Village of Cadiz, or any amendment or other comprehensive plan as from time to time may be adopted by the Village Planning Commission and the Council of the Village of Cadiz.
   (b)   Permitted Uses. Any use permitted in any Residential District shall be permitted in a “C-1" District. Any retail or personal service establishments such as:
Food stores; drug stores, gift shops; dry cleaning-laundry stores; banks; funeral homes; boarding & rooming houses; office buildings and medical buildings; essential public services, facilities and buildings; repair garages; gasoline and petroleum sales or storage; hotels, motels and tourist accommodations; variety discount stores; sales and repair shops for furniture, tools and appliances; and any other commercial service and mercantile establishments not specifically mentioned above.
   The above uses shall be permitted only providing such use is not noxious, dangerous or offensive by reason of emission of odor, dust, smoke, gas fumes, noise, flame or vibration; and adequate facilities for the temporary storage of refuse, waste, junk, objects to be repaired and disposed of are provided and the same screened from view.
   (c)   Accessory Uses. Off-street parking and loading; outdoor advertisement and signs and other accessory uses customarily incidental to the principal uses.
   (d)   Zoning Uses Permit. A “Zoning Use” permit is required for the commencement of any of the specific uses set forth above and such “Zoning Use” permit is also required for a change of existing permitted use to another permitted use.
   (e)   Development Standards.
      (1)   Lot dimensions. A lot or parcel that a commercial enterprise is to be located shall be of sufficient size to accommodate the principal structure, parking and green space as required within this Zoning Ordinance, in no case shall the lot width be less than fifty (50) feet nor less than one hundred (100) feet in depth.
      (2)   Front yard, side yard and rear yard. The front yard shall have a minimum depth of fifty (50) feet measured from the street right-of-way line to the structure front. Parking, driveways and green areas are permitted within the front yard.
   One side yard shall have a width of twelve (12) feet unobstructed to allow access for a truck or in the case of an emergency, a fire truck. The other side yard may abut the side property line.
The rear yard shall have a minimum depth of thirty (30) feet.
      (3)   Structure height. No principal structure or accessory structure, sign or other structure shall have a height greater than thirty-five (35) feet above the established grade, including a free standing antenna, except where regulated by the Federal Communications Commission or other State/Federal regulations.
      (4)   Required buffer areas. Wherever a use permitted in the “C-1" General Commercial District is adequate to any Residential Use including those permitted in “R-1", “R-2" and “R-3" Residential Districts, a ten (10) foot buffer shall be required along the side yard so abutting any residential use, and a thirty (30) foot buffer shall be required along the rear yard so abutting any residential use. This buffer shall provide a screen or mask or otherwise block the view of the “C-1" use from the residential use. (See Chapter 1105; Definitions for the meaning of Buffer.)
      (5)   Temporary storage of waste materials. Whenever an area is set aside outside of any structure to be used for the temporary storage of waste materials, garbage, etc., that storage areas must be enclosed or screened from view by a wall, fence or other structure to a height of at least six (6) feet, and shall not be located in the front yard area, not closer than ten (10) feet to any adjoining property lines.
      (6)   Required green area. The first ten (10) feet from the property line shall be reserved as a green area, except for access or driveways, to be planted and maintained with grass and/or vegetation. The area between the road pavement and the property line (right-of-way line) shall also be planted and maintained as a green area. In addition, there shall be a minimum of fifteen percent (15%) of the total land area reserved for green area, exclusive of parking, driveways or building areas, and that fifty percent (50%) of the green area shall be located within the front yard area. When required, the side yard or rear yard buffer shall be included in the fifteen percent (15%) green area. (Ord. 97-27. Passed 6-19-97.)
