1113.04 “R-3" MULTI-FAMILY RESIDENTIAL DISTRICT.
   (a)   Purpose. The “R-3" Multi-Family Residential District is to permit medium to high density multi-family dwelling units or apartments. The lot size to accommodate a structure with three (3) or more dwelling units shall be based upon the number of dwelling units contained within the structure or structures placed upon the lot, however, in no case shall the lot be less than sixteen thousand (16,000) square feet. For every dwelling unit there shall be a minimum of four thousand (4,000) square feet of land area per lot. Multi-family structures shall be connected to the Village of Cadiz sanitary sewer collection system and to the water distribution system.
   The following uses, and conditions, shall be deemed Multi-Family Residential District (R- 3) uses and permitted in all R-3 Districts. Any use permitted in an “R-1" and “R-2" shall be permitted in a “R-3" District.
   (b)   Permitted Uses.
      (1)   Apartments or condominiums. No apartment house or condominium shall be erected, or building altered for that purpose, on less than four thousand (4,000) square feet of lot area per family, with a minimum lot area of sixteen thousand (16,000) square feet.
      (2)   Uses permitted by a Conditional Zoning Permit as provided for in Section 1113.03(b) (Permitted Uses) in R-2 Single-Family Residential District, and in Section 1113.03(d) (Conditional Zoning Certificate).
   (c)   Accessory Uses.
      (1)   Detached garages and car ports.
      (2)   Maintenance buildings.
      (3)   Refuse disposal area.
      (4)   Separate laundry facilities.
      (5)   Recreational buildings and club houses.
      (6)   Offices, gatehouses, security units.
   (d)   (EDITOR’S NOTE: Former subsection (d) was repealed by Ordinance 2013-26, passed October 3, 2013.)
   (e)   Development Standards.
      (1)   Height regulations. A building cannot exceed three (3) stories or thirty (30) feet from the grade level.
      (2)   Side yard.
         A.   There shall be a side yard on each side of every main building. The minimum distance between each building on the same lot shall be thirty (30) feet. The minimum width of each side yard shall be thirty (30) feet. If any building exceeds twenty (20) feet in height the width of each side yard and distance buildings shall be increased by one (1) foot for each (1) foot of height of the building over twenty (20) feet from the established grade level.
         B.   If the property abuts an “R-1" or “R-2", then twenty (20) feet of the required side yard shall be considered a buffer zone. This buffer shall block the view of the “R-3" use from the other residential use. (See Chapter 1105; Definitions for the meaning of buffer.)
      (3)   Rear yards. Whenever a use permitted in the “R-3" Residential District is adjacent to any residential use including those permitted in “R-1 or “R-2", then a sixty (60) foot rear yard set-back width, a thirty (30) foot buffer shall be required along the rear so abutting any use as defined in the above zone districts. This buffer shall provide a screen or mask or otherwise block the view of the “R-3" use from the residential use. (See Chapter 1105; Definitions for the meaning of Buffer.)
   If the “R-3" district abuts a “C-1", “A-1" or “M-1" District, then a forty (40) foot rear yard set-back shall be required.
      (4)   Set-back building line. A minimum of forty (40) feet from the limit of public highway right-of-way line shall be the front building line.
      (5)   The overall dimensions of any side of any principal residential structure shall be less than twenty-four (24) feet.
      (6)   All structures or building having an overall first floor area of greater than one hundred (100) square feet shall have an approved foundation according to the rules and regulations of the Village of Cadiz for foundations, Harrison County Building Code or the State of Ohio Building Code.
      (7)   Whenever an area is set-aside outside of any structure to be used for the temporary storage of waste materials, garbage, etc., that storage must be enclosed or screened from view by a wall, fence or other structure to a height of at least six (6) feet, and shall not be located in the front yard area, nor closer than ten (10) feet to any adjoining property lines.
      (8)   The first ten (10) feet from the property line, shall be reserved as a green area (except for access or driveways) to be planted and maintained with grass and/or vegetation. The area between the road pavement and the property line (right-of-way) shall also be planted and maintained as a green area. In addition, there shall be a minimum of fifteen percent (15%) of the total land area reserved for green area, exclusive of parking, driveways, or building area, and that fifty percent (50%) of the green area shall be located within the front yard area (from the front of the structure to the front property line). When required, the side yard or rear yard buffer shall be included in the fifteen percent (15%) green area.
