(a) There is hereby created a fund designated “The Shade Tree Fund of the Village of Cadiz, Ohio”.
(b) All gifts received and accepted by or on behalf of the Village of Cadiz for the purpose of planting, maintaining, protecting, utilizing and promoting shade trees in accordance with the plans and regulations of the Shade Tree Commission shall be paid into such Shade Tree Fund of the Village of Cadiz, Ohio.
(c) A proposed donation to such Trust Fund given expressly for a specific purpose, before the Village of Cadiz shall be deemed to have accepted such donation, shall be approved by the Council of the Village.
